Terms of Service ("Terms")

Welcome to FindMy. These Terms of Service govern your use of the FindMy web application and all related services, products, and content. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms and Jurisdiction

  1. Binding Agreement: These Terms constitute a binding legal agreement between you and Ezelbee, LLC ("Owner").
  2. U.S. Visitors Only: This service is intended for and offered only to visitors and users located in the United States of America. By using the Service, you affirm that you are a resident of the United States.
  3. Governing Law: The laws of the State of Texas, United States, excluding its conflicts of law rules, shall govern these Terms and your use of the Service.

2. Use of Service and Account Security

  1. Account Integrity: You agree to provide accurate, current, and complete profile information.
  2. Security: You are responsible for safeguarding your password. The Owner is not liable for any loss or damage arising from your failure to comply with this security obligation.
  3. Administrative Access: You acknowledge that Super Admins and Admins have authorized access to your account data, tag data, scan history, and may temporarily **impersonate your session** for support, maintenance, or security auditing, with all such access being logged.

3. Dispute Resolution, Arbitration, and Waivers

  1. Mandatory Binding Arbitration: Any dispute or claim arising out of or relating to these Terms or the Service shall be determined exclusively by **binding arbitration** in **Bexar County, San Antonio, Texas, United States**.
  2. Waiver of Venue: You expressly waive any right to bring any dispute in any other court, venue, or jurisdiction.
  3. Arbitration Costs: The user shall bear all costs of arbitration, including the arbitrator's fees, unless otherwise prohibited by applicable Texas State or U.S. Federal law (such as cases where a statute shifts costs).
  4. Waiver of Class Action: You and the Owner agree that all claims must be brought only on an individual basis. You **waive all rights to any class, collective, or representative action or class-wide arbitration**.

4. Limitation of Liability

The Owner shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service or inability to use the Service, including but not limited to damages resulting from lost items, data loss, or system errors.


Privacy Policy

This Privacy Policy describes how Ezelbee, LLC ("Owner") collects, uses, and discloses information collected through the FindMy web application ("Service").

1. Information We Collect

  1. Account Information: Name, email, phone, and address provided during registration.
  2. Scan Data: When a tag is scanned, we collect the time, IP address, user agent, and attempt to collect **Precise GPS coordinates** (latitude, longitude, accuracy). If GPS is denied, **IP-Based approximate location** is used.
  3. Activity Logs: We log all critical user actions (login, logout, create/edit/delete user/tag, password changes) and administrative actions (user switching) along with the IP address.

2. How We Use Information

  1. Item Recovery: Your configured contact information (Name, Phone, Email, Address) is displayed to the finder when your active tag is scanned.
  2. Security and Auditing: Activity Logs are used for security, compliance, and auditing of administrative actions, including tracking admin impersonation sessions.
  3. Notifications: Your email is used to send tag scan alerts, account security notifications, and password reset communications.

3. Data Subject Rights and U.S. Compliance

  1. U.S. Visitors Only / GDPR Exclusion: The Service is offered exclusively to residents of the United States. Due to this scope limitation, the **European Union's General Data Protection Regulation (GDPR) does not apply** to our data processing.
  2. Data Requests (Access/Deletion): If you reside in a U.S. jurisdiction that grants you the legal right to request access to or deletion of your personal data, you must submit a verifiable request via the designated contact email below.
    • Deletion of a user account must be performed by an administrator, which results in all owned tags being **reassigned and set to inactive**.
    • Deletion of scan history for a tag is a **soft-delete**, meaning the record is marked as deleted but retained in the database.
